Mukhlas And Imam Samudra Handed Out An Open Letter

Two
of the accused Bali Bombers who are on death rows, Mukhlas and Imam Samudra sent
out an open letter for journalists during a visit by “Tim Pengacara Muslim (TPM)”
or "The Muslim Advocates Team" at the Nusakambangan Island Prison, Cilacap,
Indonesia on Wednesday.
Both of the accused wrote the hand written letter in black ink on a piece of
lined folio paper which was then photocopied by the TPM and later delivered to
the journalist Dermaga Wijayapura.
Beside presenting the letter, a member of the TPM, Qadar Faisal also read out
the letter from Mukhlas and Imam Samudra, in front of the reporters.
In his letter, Mukhlas elucidated us on the issue of why he did not appeal for
clemency and also on his perception of the ‘execution’.
The following is from the letter written by Mukhlas.
"(1) CLEMENCY. If I apply for clemency, it can fall into four sins and
errors.
a. Shirk (associating partners with Allah), because the secular country’s
president, who follows a system (religion) of democracy, has taken away the
authorities and sovereignty’s rights of Allah in creating and establishing the
law, therefore if I apply for clemency from him in cases of jihad like what I
have performed, it would mean that I am acknowledging his ‘lordship’.
b. Haram, because shirk is haram and in fact it is the biggest and unforgivable
sin.
c. In disgrace, I am a Mujahid who is on the true side because I am defending
Allah’s religion and the Muslim community, whereas the president in this regard
is not on the true side and not on Allah’s side but on the side of 'taghout' (satan).
Therefore if I appeal to the party who is not upon the truth, then that of my
action would be even more wrong and it would be a disgrace.
d. Aiding tyranny. The law used to judge my case (jihad) is the law of 'taghout'
which is in contradiction with Al-Qur'an and Assunah (Allah’s law, in fact what
is funnier is that, it is also in contradiction to the positive taghout’s law
exercised in this country). Therefore, if I apply for clemency, it would mean
that I am agreeing with the practice of the corrupt law and that I am aiding
tyranny, which is an obligation for us to oppose, and would become a black
record in history.
(2) EXECUTION. My comment on the execution agenda.
a. To die as a shaheed is my ambition, my desire and my yearning. So if Allah
Ta`ala wills that I will be killed by the kafir including the munafiq and the
murtadeen by way of execution, it would mean that my highest ambition is
achieved. Alhamdulillah.
b. I, as a Muslim with the aqeedah of the salaf and committed with the shariah
of Allah, it’s haram upon me to agree with the execution because executing or
killing a Muslim, not to mention a Mujahid, purposely and planned without the
authority of Allah is a criminal act and a very great sin. The entire party
involved will get the wrath and curse of Allah, and will be thrown into the hell
of jahannam forever. [QS An-Nisa (4): 93]. And as a response, all those who are
involved must be equally punished (Qishas) in this earthly life, blood for
blood, life for life.

There
is a difference in the content of this letter written by Mukhlas from the
previous statement made and conveyed through Qadar Faisal when they were
questioned about the implementation of the execution.
According to Qadar, the three accused for the Bali Bombing I case, namely Amrozi,
Mukhlas, and Imam Samudra stated that they were ready to be executed in whatever
ways.
"They are ready because they are not in a position to choose, whatever the
methods is," he said.
If they choose, he said, it would mean that they are agreeing with the sentence.
Meanwhile the contents of the letter from Imam Samudra was more of an
elucidation about the two forces, namely the forces of Allah SWT and the forces
of taghout. The following is the quote from the letter:
"There are only two forces existing: 1. The forces of Allah 2. The forces of
taghout.
(1). The forces of Allah= thoughts, feelings, speeches, and actions are only
listening to the law of Allah/Islam (Al-Qur'an and As-sunnah),
(2) The forces of 'taghout' = thoughts, feelings, speeches, and actions are not
for the sake of Allah’s law (Islam).
Therefore we are the forces of Allah, because we are clearly doing 'jihad fie
sabilillah', whereas they, who work and struggle for the sake of KUHP
(Indonesia’s Book of Criminal Laws), are obviously the forces of 'taghout' (satan).
Starting from the president, the judges, prosecuting attorneys and the police as
well as the executor who planned for our execution are the forces of satan."
The unsigned letter from Imam Samudra was ended with a reference to QS An-Nisa
(4):75 which says, that the believers fight in the way of Allah and the kafir
fight in the way of taghout (satan).
